LSC 'Private Money Restriction" is Subject of Letter From National Asian Pacific American Legal Consortium and Other Civil Rights Groups Seeking Action by Congress to Correct Harms

In November 30, 2004, 13 Asian American national and local civil rights groups, led by the National Asian Pacific American Legal Consortium, sent a letter concerning the LSC "private money restriction" to Representatives Frank R. Wolf (R-VA) and José E. Serrano (D-NY), respectively Chairman and Ranking Member of the House Commerce, Justice, State, and the Judiciary Subcommittee. This restriction prevents LSC grantees from using any non-LSC funds (in addition to their federal LSC funds) to finance a range of advocacy activities, including representing certain immigrants. LSC grantees may use these private funds free of the various federal restrictions only if they first dedicate a portion of their non-LSC funds to establish a physically separate office with a separate executive director, separate staff, and separate equipment. In the letter, the organizations stated that more than 60 percent of the Asian American community are immigrants, and that "[t]hese individuals and families have an enormous and pressing need for linguistically accessible legal assistance on a variety of common legal problems including those involving domestic violence, healthcare, housing, labor, immigration, education, and discrimination matters that is often unavailable because of the LSC private money restriction."
